Департамент мобілізації відповів на звернення Українського Руху Пацифістів щодо внесення змін до законодавства для припинення свавільних затримань і катувань сумлінних відмовників, готових до невійськового захисту миру в Україні та у світі. Тим часом Україна продовжує не виконувати вимоги Єврокомісії щодо припинення переслідувань сумлінних відмовників, і сьогодні стало відомо про засудження до 5 років тюрми в’язня сумління, адвентиста Андрія Скляра Козелецьким районним судом Чернігівської області.

Meanwhile, Ukraine continues to disregard the European Commission’s demands to stop persecuting conscientious objectors. Today Andrii Skliar, an Adventist and prisoner of conscience, was sentenced to five years in prison by the Kozelets District Court in the Chernihiv Oblast (read the article in English below).

Викладені у зверненні пропозиції та концептуальні підходи щодо реалізації права на альтернативну службу в умовах воєнного стану прийняті до відома та будуть опрацьовані в межах компетенції під час аналізу можливих напрямів законодавчих змін, пише Заступник директора Департаменту – начальник управління мобілізаційної підготовки та мобілізації Департаменту мобілізації Міністерства оборони України полковник Віктор Кузьмінський.
Заява пацифістів була відправлена суб’єктам законодавчої ініціативи, включаючи Кабінет міністрів України, з якого її надіслали до Міністерства оборони. У заяві пацифісти пропонують розробити та затвердити на державному рівні стратегію невійськового захисту миру в Україні та світі, визначити державні установи та інститути громадянського суспільства, відповідальні за виконання цієї стратегії, розробити проект Закону України “Про невійськовий захист миру” на заміну застарілому, протиправному і антиконституційному Закону України “Про альтернативну невійськову службу”, а також прийняти зміни до Закону України “Про військовий обов’язок і військову службу”, якими повністю звільнити сумлінних відмовників від усіх форм військового обов’язку, починаючи із заміни військового обліку на альтернативний облік сумлінних відмовників для цілей невійськової служби із захисту миру під цивільним керівництвом із залученням сумлінних відмовників.

“Необхідно подбати, щоб сумлінних відмовників не примушували до військового обліку та служби і не катували у марних спробах змусити людей йти проти совісті, оскільки такий примус є тяжким порушенням прав людини, яке неприпустиме навіть під час війни відповідно до Конституції та міжнародних договорів України. Такий примус принижує свободу мати сумлінну відмову (релігійний чи інший світогляд, несумісний із виконанням військового обов’язку) всупереч п. 2 ст. 18, п. 2 ст. 4 Міжнародного пакту про громадянські і політичні права та створює привілеї (для тих, хто не має сумлінної відмови) і обмеження (для тих, хто має сумлінну відмову), дискримінуючи сумлінних відмовників за ознакою релігії чи переконань всупереч ч. 2 ст. 24, ч. 2 ст. 64 Конституції України. Крім того, цим порушуються вимоги заміни для сумлінних відмовників усіх форм військового обов’язку, включаючи військовий облік, на альтернативну невійськову службу (і облік для її цілей) відповідно до ч. 4 ст. 35 Конституції України. Припинення переслідувань сумлінних відмовників під час війни і запровадження альтернативної невійськової служби є вимогою Єврокомісії, без виконання якої Україна не зможе стати членом ЄС; п. 2 ст. 10 Хартії основних прав ЄС вимагає захисту права на сумлінну відмову, і п. 9.7 Рекомендації ПАРЄ 1742 (2006) вимагає законодавчого закріплення права людини, зокрема, бути зареєстрованою як сумлінний відмовник до, під час або після військової служби” – йдеться у заяві.
У своїй заяві пацифісти посилаються на дані щорічного звіту Європейського бюро сумлінної відмови, Щорічну доповідь Уповноваженого Верховної Ради України з прав людини про стан додержання та захисту прав і свобод людини і громадянина в Україні у 2025 році, звіт Управління Верховного комісара ООН з прав людини “Чотири роки з початку повномасштабного вторгнення в Україну: ключові факти та висновки” за лютий 2026 року, аналітичний звіт УВКПЛ ООН А/HRC/62/24, де цитувалися стурбованості Комітету з питань насильницьких зникнень ООН та Комітету проти катувань ООН, а також звіт Незалежної міжнародної комісії ООН з розслідування порушень в Україні, Звіт Європейської Комісії щодо прогресу України в межах Пакета розширення 2025 (Ukraine 2025 Report) від 04.11.2025 р. № SWD(2025) 759 final, меморандум комісара Ради Європи з прав людини Майкла О’Флаерті та висновок Венеційської комісії № 1219/2024 від 18 березня 2025 року.
Пацифісти підкреслюють, що згаданий у висновку Венеційської комісії приклад організації Квакерами «Служби швидкої допомоги Друзів» (Friends Ambulance Unit), в якій могли проходити «службу, важливу для нації» тисячі офіційно зареєстрованих сумлінних відмовників будь-якої конфесії під час Першої і Другої Світової Війни у Великобританії, “на нашу думку, показує приклад належного забезпечення права на сумлінну відмову відповідно до міжнародних стандартів під час війни, коли не держава диктує віруючим, як їм виконувати обов’язок перед суспільством, а коли під Божим керівництвом, слідуючи вимогам власної совісті, віруючі добровільно створюють суспільно важливу і керовану ними, відповідну своєму світогляду і віросповіданню службу, яка офіційно визнається корисною для нації, і віруючим та їх однодумцям надається можливість саме у такий спосіб захищати Вітчизну”.
З цього приводу полковник Віктор Кузьмінський зазначив, що реалізація права на відмову від військової служби з мотивів совісті можлива за умови наявності чіткої, прозорої та недискримінаційної процедури проходження альтернативної (невійськової) служби. Водночас чинна редакція Закону України “Про альтернативну (невійськову) службу” не передбачає направлення громадян на альтернативну (невійськову) службу замість їх призову на військову службу під час мобілізації, в особливий період.
“В умовах збройної агресії російської федерації проти України, коли під загрозу поставлено життя, здоров’я, безпека громадян та саме існування держави, існує нагальна потреба у належному комплектуванні Збройних Сил України для ефективної відсічі агресії. Забезпечення балансу між правом особи на відмову від військової служби з мотивів релігійних переконань та інтересами національної безпеки і захисту прав інших осіб потребує об’єктивної перевірки відповідних заяв. Така перевірка має передбачати підтвердження наявності у особи щирих і послідовних релігійних переконань, що унеможливлюють проходження військової служби. При цьому така оцінка не повинна обмежуватися виключно фактами членства у зареєстрованих релігійних організаціях, віровчення яких забороняє військову службу або використання зброї” – стверджує начальник управління мобілізаційної підготовки та мобілізації.
Полковник Кузьмінський також зазначив, що “питання запровадження та функціонування альтернативної служби для осіб, переконання яких несумісні з військовою службою, перебуває на стадії опрацювання. Відповідні підходи обговорюються за участю релігійних організацій, центральних органів виконавчої влади та інших державних інституцій. На сьогодні Мінекономіки, на виконання окремих доручень Уряду, здійснює координацію роботи між заінтересованими органами державної влади щодо розроблення проєкту закону стосовно забезпечення права на проходження альтернативної служби в умовах воєнного стану”.
На Міжнародний день сумлінних відмовників, Громадська організація “Український Рух Пацифістів” провела загальні збори, на яких було прийнято заяви про засудження ескалації війни та про готовність сумлінних відмовників до ненасильницького захисту миру в Україні та у світі. Пацифісти обговорили щорічний звіт Європейського бюро сумлінної відмови за 2025 рік про сумлінну відмову від військової служби в Європі та аналітичний звіт УВКПЛ ООН щодо досягнень і проблем у питанні захисту права на сумлінну відмову в світі. Відбулася дискусія щодо моделей альтернативної невійськової служби з особливою увагою до досвіду Швеції, судових та адміністративних процедур захисту прав людини. Учасників надихнули пісні: «Гімн вільних цивільних», «Я не похитнусь» і «Антивоєнна пісня про Квакера». Учасники зборів дійшли згоди щодо необхідності посилення моніторингу порушень прав людини, правозахисної роботи та адвокації на національному та міжнародному рівні.

Заява про готовність сумлінних відмовників до ненасильницького захисту миру в Україні та у світі
Нам часто повторюють, що війна буде нескінченною і всі повинні брати у ній участь. Наше сумління повстає проти такого світогляду.
Ми переконані, що кожна людина має право на мир – і світ потребує не воїнів, а мирних людей, які відмовляються вбивати і працюють заради миру. Адже якщо б усі люди відмовилися вбивати, у світі не було б воєн. Якщо б усі росіяни відмовилися йти у путінську армію і виконувати накази диктатора, це був би кінець злочинного вторгнення, окупації, жорстоких бомбардувань та ядерного шантажу. Поки цього не сталося, потрібно, принаймні, працювати заради того, щоб це сталося у майбутньому. І сумлінні відмовники є тими людьми, які хочуть і можуть займатися цією роботою.
Мирному руху не вистачає людей. Тому ми кличемо приєднуватися до нас усіх, хто хоче разом з нами виконувати свій моральний і юридичний обов’язок захищати мир в Україні та у світі невійськовими методами ненасильницьких дій.
Державі потрібно підтримати прагнення сумлінних відмовників захищати мир в Україні та у світі з кількох причин:
- щоб війна не затягувалася, оскільки у пацифістів є план і прагнення працювати заради справедливого миру;
- бо неможливо змусити пацифістів воювати, але можливо і потрібно дозволити і допомогти їм захищати мир та злагоду між людьми і народами в якості вільних цивільних громадян;
- бо знищити сусідську країну з усім її населенням військовими методами нереально, і треба всім народом шукати мирні способи змінити поведінку сусідів та спонукати їх позбутися військової диктатури і марних прагнень завоювати Україну та перемогти Захід;
- бо запровадження альтернативної невійськової служби є нагальною необхідністю, адже захист прав людини і пошук мирних шляхів завершення війни – це справа всього народу і обов’язок Держави за Конституцією та міжнародними угодами України, включаючи Статут ООН та Міжнародний пакт про громадянські і політичні права;
- крім того, Європейська Комісія вимагає припинити в Україні репресії проти сумлінних відмовників, адже це суперечить Хартії основних прав Європейського Союзу.
Пропонуємо розробити та затвердити на державному рівні стратегію невійськового захисту миру в Україні та світі, визначити державні установи та інститути громадянського суспільства, відповідальні за виконання цієї стратегії, розробити проект Закону України “Про невійськовий захист миру” на заміну застарілому, протиправному і антиконституційному Закону України “Про альтернативну невійськову службу”, а також прийняти зміни до Закону України “Про військовий обов’язок і військову службу”, якими повністю звільнити сумлінних відмовників від усіх форм військового обов’язку, починаючи із заміни військового обліку на альтернативний облік сумлінних відмовників для цілей невійськової служби із захисту миру під цивільним керівництвом із залученням сумлінних відмовників.
Жодна армія світу не здатна зробити пацифістів солдатами. Насильство безсиле перед стійкістю вільних цивільних людей. Правова держава сильна тим, що визнає цю просту істину, не посягає на природні права людини та свободу совісті і дозволяє пацифістам сумлінно працювати, щоб мирний спосіб життя рятував країну і світ від прокляття війни.

Meanwhile, Ukraine continues to disregard the European Commission’s demands to stop persecuting conscientious objectors. Today, it was revealed that Andrii Skliar, an Adventist and prisoner of conscience, was sentenced to five years in prison by the Kozelets District Court in the Chernihiv Oblast.
“The proposals and conceptual approaches outlined in the petition regarding the right to alternative service during martial law have been noted. They will be reviewed within our competence as part of an analysis of potential legislative amendments,” writes Colonel Viktor Kuzminskyi, Deputy Director of the Department – Head of the Directorate for Mobilization Preparation and Mobilization of the Mobilization Department of the Ministry of Defense of Ukraine.
The pacifists’ petition was sent to the subjects of legislative initiative, including the Cabinet of Ministers of Ukraine, which forwarded it to the Ministry of Defense. In the statement, the pacifists propose to develop and approve a strategy for the non-military defense of peace in Ukraine and the world at the state level; to identify the state institutions and civil society organizations responsible for implementing this strategy; to draft a Law of Ukraine ‘On Non-Military Defense of Peace’ to replace the outdated, unlawful, and unconstitutional Law of Ukraine ‘On Alternative (Non-Military) Service’; and to adopt amendments to the Law of Ukraine ‘On Military Duty and Military Service’ that would completely exempt conscientious objectors from all forms of military duty, starting with replacing military registration with an alternative registration of conscientious objectors for the purposes of non-military service to defend peace under civilian management with the involvement of conscientious objectors.
“It is necessary to ensure that conscientious objectors are not forced into military registration and service and are not tortured in vain attempts to force people to go against their conscience, since such coercion is a grave violation of human rights, which is unacceptable even in times of war in accordance with the Constitution and international treaties of Ukraine. Such coercion impairs the freedom to have a conscientious objection (religious or other worldview incompatible with the performance of military duty) contrary to Article 18 (2), Article 4 (2) of the International Covenant on Civil and Political Rights and creates privileges (for those who do not have a conscientious objection) and restrictions (for those who have a conscientious objection), discriminating against conscientious objectors on the basis of religion or beliefs contrary to Article 24 (2), Article 64 (2) of the Constitution of Ukraine. In addition, this violates the requirements for substitution for conscientious objectors of all forms of military duty, including military registration, for alternative non-military service (and registration for its purposes) in accordance with Article 35 (4) of the Constitution of Ukraine. The cessation of persecution of conscientious objectors during wartime and the introduction of alternative non-military service is a requirement of the European Commission, without which Ukraine will not be able to become a member of the EU; Article 10 (2) of the EU Charter of Fundamental Rights requires the protection of the right to conscientious objection, and paragraph 9.7 of PACE Recommendation 1742 (2006) requires to protect by law the human right, in particular, to be registered as a conscientious objector before, during or after military service,” the statement says.
In their petition, the pacifists refer to the data of the annual report of the European Bureau for Conscientious Objection, the Annual Report of the Commissioner for Human Rights of the Verkhovna Rada of Ukraine on the state of observance and protection of human and civil rights and freedoms in Ukraine in 2025, the report of the Office of the UN High Commissioner for Human Rights “Four years since the beginning of the full-scale invasion of Ukraine: key facts and conclusions” for February 2026, the analytical report of the UN OHCHR A/HRC/62/24, which cited the concerns of the UN Committee on Enforced Disappearances and the UN Committee against Torture, as well as the report of the UN Independent International Commission of Inquiry on Ukraine, the European Commission’s Ukraine 2025 Report, the Memorandum of the Council of Europe Commissioner for Human Rights Michael O’Flaherty and the Venice Commission Opinion No. 1219/2024 of 18 March 2025.
Pacifists emphasize that the example, mentioned in the Venice Commission’s opinion, of the Quakers-founded Friends Ambulance Unit, in which thousands of officially registered conscientious objectors of any denomination could perform “service important to the nation” during the First and Second World Wars in Great Britain, “in our opinion, shows an example of proper protection of the right to conscientious objection in accordance with international standards in times of war, when it is not the state that dictates to believers how they should fulfill their duty to society, but when, under God’s guidance, following the demands of their own conscience, believers voluntarily create and manage a socially important service that corresponds to their worldview and religion, which is officially recognized as useful to the nation, and believers and their like-minded people are given the opportunity to defend the Fatherland in nonviolent, nonmilitary way.”
In this regard, Colonel Viktor Kuzminsky noted that the realization of the right to conscientious objection is possible provided that there is a clear, transparent and non-discriminatory procedure for alternative (non-military) service. At the same time, the current version of the Law of Ukraine “On Alternative (Non-Military) Service” does not provide for sending citizens to alternative (non-military) service.
“Under the conditions of the armed aggression of the russian federation against Ukraine, when the life, health, and safety of citizens, as well as the very existence of the state, are threatened, there is an urgent need to properly staff the Armed Forces of Ukraine to effectively repel the aggression. Ensuring a balance between an individual’s right to refuse military service based on religious beliefs and the interests of national security and the protection of the rights of others requires an objective verification of the relevant applications. Such verification must involve confirming that the individual holds sincere and deeply held religious convictions that make military service impossible. At the same time, this assessment should not be limited solely to the facts of membership in registered religious organizations whose doctrine prohibits military service or the use of weapons,” states the Head of the Directorate for Mobilization Preparation and Mobilization.
Colonel Kuzminsky also noted that “the issue of introducing and operating alternative service for persons whose beliefs are incompatible with military service is under consideration. Appropriate approaches are being discussed with the participation of religious organizations, central executive bodies, and other state institutions. Today, the Ministry of Economy, in accordance with certain instructions of the Government, is coordinating work between interested state authorities on the development of a draft law on ensuring the right to undergo alternative service under martial law.”
At the general assembly of the Ukrainian Pacifist Movement, held on the occasion of the International Conscientious Objectors’ Day, statements were adopted to condemn the escalation of the war and to express the readiness of conscientious objectors for nonviolent protection of peace in Ukraine and in the world. The pacifists discussed the 2025 annual report of the European Bureau for Conscientious Objection (EBCO) on conscientious objection to military service in Europe, as well as the OHCHR analytical report on new developments, best practices and remaining challenges in protecting the right to conscientious objection worldwide. A discussion took place regarding models of alternative non-military service, with particular attention to Sweden’s experience, as well as judicial and administrative procedures for the protection of human rights. The participants were inspired by the songs: “Hymn of Free Civilians”, “I Shall Not Be Moved”, and the “Antiwar Song about a Quaker”. The participants of GA reached a consensus on the need to strengthen the monitoring of human rights violations, human rights defending work, and advocacy at both national and international levels.

Statement on the readiness of conscientious objectors for nonviolent protection of peace in Ukraine and in the world
We are often told that war will be endless and that everyone must participate in it. Our conscience revolts against such a worldview.
We are convinced that every person has the right to peace — and the world needs not warriors, but peaceful people who refuse to kill and work hard for peace. Indeed, if all people refused to kill, there would be no wars in the world. If all Russians refused to join Putin’s army and obey the dictator’s orders, it would be the end of the criminal invasion, occupation, brutal bombings, and nuclear blackmail. Until this happens, we must at least work to ensure it happens in the future. Conscientious objectors are the people who want and are able to engage in this work.
The peace movement lacks people. Therefore, we call upon everyone who wishes to join us in fulfilling our moral and legal duty to defend peace in Ukraine and the world through non-military methods of nonviolent action.
The State needs to support the aspirations of conscientious objectors to defend peace in Ukraine and the world for several reasons:
- To prevent the war from dragging on, as pacifists have a plan and a desire to work for a just peace;
- Because it is impossible to force pacifists to fight, but it is possible and necessary to allow and help them defend peace and harmony between people and nations as free civilian citizens;
- Because destroying a neighboring country and its entire population by military methods is unrealistic, and the whole nation must seek peaceful ways to change the behavior of neighbors and encourage them to rid themselves of military dictatorship and futile aspirations to conquer Ukraine and defeat the West;
- Because the introduction of alternative non-military service is an urgent necessity, as the protection of human rights and the search for peaceful ways to end the war is the cause of the entire people and the duty of the State under the Constitution and international treaties of Ukraine, including the UN Charter and the International Covenant on Civil and Political Rights;
- Furthermore, the European Commission demands an end to the repression of conscientious objectors in Ukraine, as it contradicts the Charter of Fundamental Rights of the European Union.
We propose to develop and approve at the state level a strategy for the non-military protection of peace in Ukraine and the world; to identify state institutions and civil society organizations responsible for implementing this strategy; to draft a Law of Ukraine “On the Non-Military Defense of Peace” to replace the outdated, unlawful, and unconstitutional Law of Ukraine “On Alternative (Non-Military) Service”; and to adopt amendments to the Law of Ukraine “On Military Duty and Military Service” to fully exempt conscientious objectors from all forms of military duty, beginning with the replacement of military registration with an alternative registration of conscientious objectors for the purposes of non-military peace-building service under civilian leadership with the involvement of conscientious objectors.
No army in the world is capable of making pacifists into soldiers. Violence is powerless before the steadfastness of free civilian people. A state governed by the rule of law is strong because it recognizes this simple truth, does not infringe upon natural human rights and freedom of conscience, and allows pacifists to work tirelessly so that a peaceful way of life may save the country and the world from the curse of war.
